Ukraine Approves New Draft Legislation on Energy Storage and Distributed Generation, Clarifying Power Purchase Timeframes
Ukraine's National Energy and Utilities Regulatory Commission (NEURC) has approved a draft resolution aimed at implementing Laws No. 4777-IX and No. 4825-IX. This initiative updates the rules governing the retail electricity market, as well as the procedures for electricity sales and metering involving "active consumers." The draft clarifies the concept of "permitted capacity," introduces a classification system dividing electricity into two categories-guaranteed and non-guaranteed-and expands the capacity for renewable energy generators to provide backup power supply to consumer facilities.
The draft proposes that operators of energy storage facilities, including BESS battery storage system solutions and battery energy storage system components, provided they share a common connection point with a distribution system operator's network, may sell electricity to consumers pursuant to sales contracts. This is particularly beneficial for both residential battery energy storage system installations in private households and larger-scale industrial battery energy storage system projects. Concurrently, regulations concerning the supply of electricity by "suppliers of last resort" to protected consumers and critical infrastructure facilities are also set to undergo adjustments.

Operational rules for active consumers have been further clarified; specifically, the draft stipulates that for private households utilizing the "green tariff," electricity generated by photovoltaic (PV) systems may be purchased by universal service providers only during specific daytime hours: from 04:00 to 23:00 between April 1 and October 31, and from 06:00 to 21:00 between November 1 and March 31.
For active consumers utilizing self-generation mechanisms and operating under a simplified taxation regime, the draft proposes allowing for the calculation of exported and consumed electricity volumes without requiring mutual financial settlements. These amendments are designed to foster the development of active consumption, energy storage facilities, and distributed generation, thereby enhancing Ukraine's energy resilience. The draft resolution will be published on the Regulatory Commission's official website for public comment, marking the formal commencement of the regulatory review process.
