Brazilian Energy Regulator Again Delays Review of Energy Storage Rules, Sparking Investor Concerns Over Investment and System Reliability

Brazil's National Electric Energy Agency (ANEEL) has once again postponed the regulatory review process for energy storage systems, triggering concerns among investors regarding the reliability of the power grid and future investment prospects. Following the resumption of technical deliberations on Law No. 15,269 of 2025 on April 7, 2026, the proceedings were halted once more after Commissioner Willamy submitted a new request for review. Subsequently, Director Sandoval Feitosa proposed reopening Public Consultation No. 39 of 2023.
The Brazilian Association of Energy Storage Solutions (ABESS) points out that batteries & energy storage development design plays a vital role in addressing the structural challenges facing Brazil's power sector. These challenges include insufficient flexibility in power generation and demand response, renewable energy curtailment exceeding 20% for wind and solar power, reduced hydroelectric efficiency, the risk of power shortages during evening peak hours, and rapidly rising electricity tariffs.
Fabio Lima, Executive Director of ABESS, emphasized that the repeated delays lack technical justification and that reverting to the public consultation phase at this stage would inflict irreversible damage on the electricity sector. He stressed the urgent need for a clear regulatory framework to advance battery energy storage project development beyond the pilot stage and unlock large-scale investment in both co-located renewable systems and standalone facilities.
In this context, both advanced lead acid battery energy storage and modern lithium-based solutions are being considered as viable options. Additionally, many Brazilian developers are exploring cost-effective batteries for home energy storage from China to support distributed energy applications and residential backup systems.
