Germany's new draft energy storage subsidy regulations remove grid charging restrictions, allowing systems under 30 kW to opt for a fixed quota of 500 kWh per year.
Germany's Federal Network Agency recently published a draft regulation on the "Market Integration of Energy Storage and Charging Points." The draft will be open for public comment from October 1 to 24, 2025, and aims to implement the provisions of the Peak Demand Act. The draft's core objective is to fully leverage the flexibility potential of battery storage and electric vehicles while promoting more effective participation of these technologies in the electricity market.
According to the draft, operators of small, private battery systems are currently subject to "exclusivity" regulations, meaning that energy storage systems can only qualify for EEG subsidies if they are charged entirely with clean electricity (such as photovoltaic arrays). The new proposal replaces these existing rules with two proportional allocation procedures: an "allocation" option, which uses a fixed mathematical rule to precisely meter the amount of electricity drawn from the grid every 15 minutes; and a "fixed rate" option, applicable only to energy storage systems up to 30 kW in size, which automatically qualifies a fixed percentage of the electricity fed back as eligible for EEG subsidies or electricity bill credits. Under the fixed-rate option, the annual EEG subsidy cap is set at 500 kWh per kilowatt of installed capacity.
Klaus Müller, Director of Germany's Federal Network Agency, emphasized that the new regulations lay the foundation for flexibility for energy storage systems of all sizes, enabling them to actively participate in the electricity market while optimizing their own electricity consumption. He also called it a milestone in the development of bidirectional charging technology for electric vehicles. By unlocking market participation for small-scale energy storage systems and electric vehicle charging points, the draft is expected to promote load shifting, alleviate peak load pressures from renewable energy generation, and improve the efficiency of green electricity consumption. The effective date of the regulations has not yet been announced.
