Mexico's National Energy Commission Updates Grid Interconnection Contracts, Explicitly Incorporating Energy Storage Systems for the First Time with a 1 MW Entry Threshold

Mexico's National Energy Commission (CRE) has updated the standardized contract templates governing grid interconnection and connection agreements for power generation plants, energy storage systems, and large-scale electricity consumers. For the first time, these templates explicitly incorporate energy storage systems, thereby replacing the previous contracts that had been in effect since 2016.
Battery energy storage systems (often referred to as BESS) play a vital role in modern grids by storing excess electricity-typically from renewables-and releasing it when demand peaks or supply fluctuates. They rely heavily on lithium ion battery for large scale energy storage due to its high energy density, rapid response times, and proven scalability for utility-level applications.
The new contract template consolidates the various modes-whether involving interconnection, connection, or a combination of both-into a single unified document. Compliance is mandatory for licensed power generation plants, energy storage systems, and load centers that participate in the wholesale electricity market or have a demand equal to or greater than 1 megawatt (MW).
The new contract reinforces the responsibilities of the National Energy Control Center (CENACE), which is now required-once technical conditions have been met-to issue directives for contract execution and order the physical connection of facilities. The timeframe for contract execution is capped at ten business days following the receipt of such directives, while the physical connection itself must be completed within 72 hours of the corresponding order being issued. Developers are required to bear the costs of necessary infrastructure, including metering systems and specific engineering works, and must provide a financial guarantee that can be enforced in the event of a contractual default. Furthermore, the contract stipulates penalties for refusing metering system verifications and details specific grounds for contract termination, including significant delays in construction.
Energy storage systems are required to hold a license issued by the National Energy Commission and must assume the same contractual obligations as power generation plants. While the contract permits modifications via formal amendments, any structural changes require prior approval from the regulatory authority. The new template supports the use of electronic signatures and digital contract management, and establishes adjustment mechanisms to address regulatory changes that may impact the economic balance of the contract. Facilities utilizing distributed generation with an installed capacity of less than 0.7 MW are exempt from this template; such exempted generation facilities are permitted to operate solely in conjunction with a specific load center and are strictly prohibited from exporting electricity to the National Electric System.
